Standard Terms & Conditions of Service

MDS VisaPak provides a visa and passport acquisition service to its customers.
  1. Definitions

    • “Relevant Authority” shall mean the Department of Home Affairs, an embassy or consulate of a foreign country or any other authority or agent to which application may be made. “Travel document” shall mean any passport, visa or document issued by a relevant authority.
  2. Scope of Service

    • A completed visa or passport application delivered to, or collected by MDS will, where possible be scanned for completeness by MDS staff before being submitted to the relevant authority for consideration. Failure to find errors or omissions on applications shall not be construed as a breach of service.
    • Where necessary MDS will disburse on behalf of the Customer, the funds necessary to cover the costs of such submission to the relevant authority.
    • These disbursements shall be paid to MDS by the Customer on demand, whether the travel document has been issued or not. Failure to pay such disbursements within 7 days of such demand shall attract additional disbursement charges, which are set by MDS from time to time.
    • Once the travel documents have been collected from the relevant authority, MDS will return the travel documents to the Customer. Should the Customer not have the necessary credit facilities or be in arrears with payment, then MDS has the right to hold such travel documents until such time that the Customer has settled its account to MDS’ satisfaction.
    • MDS will provide to the Customer, information regarding costs, requirements and application forms relating to the acquisition of travel documents. This information will be provided to the best of MDS’ ability and knowledge at the time. MDS will not be responsible should the information provided be in any way inaccurate or outdated.
    • MDS shall charge such service fees as it deems necessary or that have been agreed upon for its services and such fees are due and payable once MDS has received the application on behalf of the Customer.
  3. Liability

    • MDS’ liability to its Customers for any negligent or grossly negligent error or omission by an MDS staff member shall be limited to an amount of R10 000.00 for direct costs incurred by the Customer as a result of any one incident of such negligence. Consequential or indirect costs are specifically excluded.
    • Where MDS fails, delays or is unable to carry out its obligations under this contract or any loss occurs due to strikes and / or lockouts (whether of MDS’ own employees or those of others and whether or not MDS could have avoided the same by acceding to the demands of the employees responsible for such action), acts of God, war, terrorism, criminal acts of third parties such as theft and arson, fire, flood, embargo, litigation, acts of government or any agency instrumentality or any political subdivision thereof or any other cause beyond the control MDS.
    • MDS will not be liable for the negligent actions of third parties which result in loss or damage to the Customer, in particular courier companies used in the process of obtaining travel documents.
  4. Use of Website and Payment Gateway

    • Subject to availability and receipt of payment, requests will be processed within 1 day and delivery confirmed by way of email (for eg booking number/ booking voucher etc).
    • Return and Refunds - The provision of goods and services by MDS VisaPak is subject to availability. In cases of unavailability, MDS VisaPak will refund the customer in full within 30 days.
    • Customer privacy - MDS VisaPak shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined Protection of Personal Information Act, No. 4 of 2013, which can be downloaded from
    • Payment may be made via Visa, MasterCard, Diners or American Express credit cards or by bank transfer into the MDS VisaPak b.ank account, the details of which will be provided on request.
    • Credit card acquiring and security - Credit card transactions will be acquired for MDS VisaPak via PayGate (Pty) Ltd who are the approved payment gateway for Standard Bank of South Africa. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website. Users may go to to view their security certificate and security policy.
    • Customer details will be stored by MDS VisaPak separately from card details which are entered by the customer on PayGate’s secure site. For more detail on PayGate refer to
    • The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is South African Rand (ZAR).
    • MDS VisaPak takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.
    • This website is governed by the laws of South Africa and MDS VisaPak chooses as its domici!ium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, 58C Webber St, Selby, Johannesburg, 2016.
    • MDS VisaPak may, in its sole discretion, change this terms and conditions or any part thereof at any time without notice.
  5. Standard Terms & Conditions of Competitions

    • Prizes are subject to change at the discretion of MDS Group.
    • Prizes not claimed within 30 days will be redistributed.
    • Unless otherwise stated, prizes are only available to South African residents.
    • Winners will be chosen from those who have completed all competition steps.
    • Adjudication of the winners is the decision of a competent manager of MDS and is final.
